A federal judge has issued an injunction against Galveston County's money-bail system, which lawyers and inmates have called discriminatory against poor defendants, and Dallas County has begun implementing changes. The Texas attorney general, who also represents the criminal judge, is appealing the order. A criminal defense attorney filed a federal lawsuit Wednesday after recording a hearing in which he said he was in favor of the county's new system. But he said it must have lawyers on the same level as other Texas counties like Dallas and Fort Worth.
He argued that it was enough to hold a bail review hearing, which takes place on the first day of a defendant's first court appearance at the Galveston County Courthouse. Prosecutors do not want to attend initial hearings because they are weighing heavily on the office of District Attorney Jack Roady, he claimed in the filing. The district judge argued that having a defense attorney at an initial hearing meant little more than complexity and more time, potentially delaying the release of the defendants while they await a lawyer's financial decision.
